Why is everyone saying that selling Modded Xbox's is illegal? It is not; however, they come with no warranty. The software on the Xbox (such as games...etc.) Is what makes them illegal.

It's because M$ wants you to be little drones that are limited in what you can and cannot do. Now that being legal is B$ if I've ever heard of it. And yes, you are correct about your statement.
Compensation I don't know... What people are running into trouble with is that M$ likes to state that they don't sell them the Copyright to their Xbox...on lease it to the consumer. If it is leased, then you cannot alter it in anyway...now THAT is BS.

Well what do you expect? Its straight up copyright infrigment abilities..to be able to play unlicensed (for lack of a better word) games is completely illegal.... and its not cause of the modding...I once modded my friends Xbox..ya you heard me..I modded it..I took off the black case and installed an acrylic one.. :lol:
