Is it illegal for a cop to not read you your rights if arrested under the influence of alchohol?Could you tell me this or could someone provide me with a link for Texas State Laws.
lol some ones been bad im not sure but id say its if u asked and they didnt tell u its illegal but im not 100% sure
actually they are required to ask if you know your rights and you say yes or no but if your drunk then you either sdont remeber or you wont be able to bring it upp in cour because the cop will just say he idi ask and usally his word is stronger
You "MUST" be read your rights while being arrested. It is the law. They are called the Miranda rights. http://usgovinfo.about.com/cs/mirandarights/a/mirandaqa.htm
they need to read you your rights if their taking you in. its the rules of being a pig. if they dont read you them they can lose their job, or lose their position.
It wasnt me it ws my brother and 3 friends they were out on a tennis court they didnt even have the beer on them and they didnt take a test to see if they were drunk or not. I asked each one and they said the same story and they were also thrown in a cell with guys way older than them they were only all 17 except 1 of them and he was 18 but they were thrown in a cell block with like 20 other men and all of the men were way older then them.
i got busted for pot in AR and they didn't have to read me my rights and if i would have ****ched about it the judge would have read them and then been like u understand? and thats it it sucks but oh well gl
I'm pretty sure that they do have to read you the rights, they didn't to me once, but then again they took me by acident
No they do have to read you your rights I just look it up. They have to read you your rights before being "placed in an environment in which they do not believe they are free to leave" such as a cell block.
well over here in the uk you can't be arrested for being drunk, but you can be arrested for being disoradly.
